Abstract
The European Union recently adopted Directive 2024/2853 of 23 October 2024 on liability for defective products, which must be implemented by December 2026. This new Directive will replace Directive 85/374, which served as a source of inspiration on product liability for many countries outside the EU, including Turkey. It was born out of a desire to adapt EU law to the digital economy and its most striking feature is an extension of the scope of product liability to include immaterial products and algorithms. This extension comes with a number of modifications in the existing liabilty regime, the consequences of which have not yet been fully assessed. The conference will offer a synthetic analysis of the new Directive, stressing the tension between continuity and change, and highlighting the main issues raised by the new provisions.
