Abstract:
What options are open today when drafting European provisions on prescription in tort law? Lawmakers are confined in the magic triangle of rich national traditions, strong guidelines from the European Court of Human Rights and abundant, often very technical scholars’ analysis, and surrounded by a touch of legal esthetics and policy considerations. The seminar will be the occasion to discuss some of the challenging questions around modern European prescription.

The Comparative Tort Law Seminar Series brings together distinguished scholars from around the world to share their expertise and insights on contemporary issues in tort law, fostering a deeper understanding of comparative perspectives and interdisciplinary approaches. The opening lecture of our series will be delivered by Prof. Dr. Bénédict Winiger.

Bio:
Prof. Winiger was a full professor at the University of Geneva, Faculty of Law. He specializes in Roman law, European Civil Law, Philosophy of Law as well as Tort Law. Throughout his career, he has been awarded several research grants by the Swiss National Foundation. Between 2002 and 2011, Prof. Winiger co-directed with Prof. Koziol the research programs on “National Court Practice and European Tort Law.” He is the president of the Swiss Association for Philosophy of Law and Social Philosophy, a member of the European Center of Tort and Insurance Law, and a member of the European Group on Tort Law. Prof. Winiger has numerous publications in his fields of specialization, including Droit privé Romain II (co-authored with Prof. Dunand and Schmidlin) and La responsabilité aquilienne romaine: Damnum iniuria datum and Essential Cases on Damage.
