ABSTRACT: The talk will focus on investment dispute settlement jurisprudence, and will specifically scrutinize the ‘fair and equitable treatment’ obligation of states (towards foreign investors) in investment arbitration. Through case law, the talk aims at demonstrating how vague concepts are attested meaning, context and content through actual disputes, and looks into the incremental effect of decisions over time.
